Mit Ihrer Bestellung geben Sie ein Kaufangebot ab. AW60 behält sich das Recht vor, Ihre Bestellung nach eigenem Ermessen abzulehnen. Die Bestellung gilt erst nach Bestätigung durch AW60 als angenommen. Voraussetzung ist der Eingang Ihrer Zahlung. Bitte überprüfen Sie Ihre Bestellung vor Abgabe sorgfältig, da Stornierungen nach Annahme möglicherweise nicht mehr berücksichtigt werden können. Im Falle einer Ablehnung oder Änderung werden wir versuchen, Sie über die angegebenen Kontaktdaten zu informieren. Rückgabe und Umtausch erfolgen ausschließlich gemäß unserem Widerrufsrecht. Eigentumsvorbehalt: Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum. Preise und Angebote können sich ohne Vorankündigung ändern. Es gilt der Preis zum Zeitpunkt der Bestellung. Sofern nicht anders vereinbart, enthalten die Preise keine Verpackungs-, Fracht- oder Versandkosten. Bei Unternehmern ist auch die Versicherung ausgeschlossen. Zusätzliche Versandkosten werden vor der Bestellung klar kommuniziert. Der Kunde ist für die Angabe einer korrekten Lieferadresse verantwortlich; Mehrkosten durch fehlerhafte Daten trägt der Kunde. ABSCHNITT 5 – VERSAND UND ZUSTELLUNG

Die Lieferung erfolgt in der Regel gegen Vorkasse per Versand/Fracht. Wir haften nicht für Versandverzögerungen. Lieferzeiten sind Schätzungen und nicht garantiert. ABSCHNITT 18 – SALVATORISCHE KLAUSEL

Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Die unwirksame Bestimmung wird durch die gesetzliche Regelung ersetzt.

ABSCHNITT 19 – VERZICHTSKLAUSEL & GESAMTE VEREINBARUNG

We reserve the right to suspend, deactivate, or close your account at any time and without notice if we determine that you have violated any part of these Terms.

SECTION 14 – TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) at any time at our sole discretion without notice. In such event, you remain liable for all amounts due up to and including the date of termination. The following sections shall survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions which by their nature should survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

Statutory warranty rights apply.

For consumers, the limitation period for claims for defects is two years. For entrepreneurs, the warranty period is limited to twelve months from the delivery of the goods.

UNLESS EXPRESSLY STATED BY AW60, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED ”AS IS” AND ”AS AVAILABLE” FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AW60 BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AW60, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any loss, damage, liability, or claim, including reasonable attorneys’ fees, made by any third-party due to or arising out of (1) your breach of these Terms and Conditions or the documents they incorporate by reference, (2) your violation of any law or the rights of a third-party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to notify promptly shall not excuse you from your obligations except to the extent you are materially prejudiced thereby. We may control the defense and settlement of such claim at your expense, including the choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (which shall not be unreasonably withheld). You will cooperate in the defense of any indemnification claim, including by providing relevant documents.

SECTION 18 – SEVERABILITY

In the event that any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions. Such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions). The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
